Our Commitment to Privacy

The Krohn Breakthrough Foundation 501(c)3 nonprofit organization, is pleased to provide you with the information, content, tools, products and services on its website. For purposes of this privacy policy, “The Foundation,”, “Breakthrough Foundation,” or “Krohn Breakthrough,” shall mean The Krohn Breakthrough Foundation, a Utah certified 501(c)3 non-profit, and its affiliates, and their officers, managers, members, partners, and employees. The “Site” shall mean the website of The Krohn Breakthrough Foundation located at krohnbreakthrough.org and other domains. 

Your privacy is very important to us, and we are committed to protecting and safeguarding your privacy. It is our policy to keep your personal information confidential. Please take a moment to read the following Privacy Policy to learn how we handle your personal information. The Krohn Breakthrough Foundation does not collect personal information about individuals who visit the Site, except when the information is specifically provided on a voluntary basis.

Information Collected

The Foundation may collect personal information (including name, address, telephone number, email address and, when necessary, credit card information) when you:

Placing an Order on the Site

Return an item or make an exchange; or

Inquire about products and services

In addition, you may voluntarily provide personal information (such as name, address, email address, and telephone number) to be forwarded to The Foundation or a Foundation Ambassador for the purpose of contacting you with details regarding The Foundation’s services or the The Foundation Ambassador opportunity, including contact by email. In this case, The Foundation will keep a record of the contact, including the personal information. The Foundation uses this information to provide better service in the event that you contact The Foundation again.

When you decide to become an authorized The Foundation Ambassador, or when you register to use The Foundation’s services online, The Foundation will collect personal information (such as name, address, email address, and telephone number). This personal information is securely stored. You will be assigned an identification number and you will select a password, which will be necessary to gain entrance to the Site and to access your personal information.

The Foundation may also collect non-personally identifiable information from you when you visit the Site (e.g., your IP address, browser type, domain name, etc.). This information is collected and analyzed in the aggregate in order to improve the function and content of the Site.

Cookies

Like many websites, the Site uses “cookie” technology. A “cookie” is a small data file transferred to your computer’s hard drive that allows a website to respond to you as an individual, gathering and remembering information about your preferences. When you first connect to the Site, the cookie identifies your browser with a unique, random number.

The cookies The Foundation uses do not reveal any personal information about you, except perhaps your first name so The Foundation can welcome you on your next visit. Cookies help The Foundation understand which parts of the Site are the most popular, where visitors are going, and how long they spend there. The Foundation uses cookies to study traffic patterns on the Site so The Foundation can make the Site even better.

The Foundation intends to protect against the loss, misuse or alteration of information that The Foundation has collected from you. However, no data transmission over the Internet can be guaranteed to be 100% secure, and while The Foundation strives to protect your personal information, The Foundation cannot guarantee or warrant complete security.

The Foundation uses a variety of current technologies and processes for protection of data. The Foundation limits the information The Foundation provides to outside companies with whom The Foundation contracts to only what they need to carry out their responsibilities. When you make a purchase on the Site, your transactional information is transmitted in a safe, encrypted format.

Third Party Websites

The Site may provide hyperlinks, which are highlighted words or pictures within a hypertext document that, when clicked, take you to another place within the document, to another document altogether, or to other web sites not controlled by The Foundation.

These hyperlinked web sites may contain privacy provisions that are different from those provided herein. The Foundation is not responsible for the collection, use, or disclosure of information collected through these web sites or links, and The Foundation expressly disclaims any and all liability related to such collection, use, or disclosure.

Disclosure Required By Law & Other Disclosure

The Foundation reserves the right (and you authorize The Foundation) to share or disclose your personal information when The Foundation determines, in its sole discretion, that the disclosure of such information is necessary or appropriate:

To enforce our rights against you or in connection with a breach by you of this Privacy Policy or the Terms and Conditions;

To prevent prohibited or illegal activities; or

When required by any applicable law, rule regulation, subpoena or other legal process.

Personal information may be transferred to a third party as a result of a sale, acquisition, merger, reorganization or other change of control. If The Foundation sells, merges or transfers any part of its business, part of the sale may include your personal information. If so, you will be asked if you’d like to stop receiving promotional information following any change of control.

Email Communications

The Foundation may allow users to subscribe to email newsletters and from time to time may transmit emails promoting The Foundation’s or third-party goods or services.

You have the ability to opt-out of receiving our promotional emails and to terminate newsletter subscriptions by following the instructions in the emails. Opting out in this manner will not end transmission of certain service-related emails.

Protection of Children’s Privacy

A general audience website that is not specifically designed or targeted at children. If you are under 18, you may use the Site only with involvement of a parent or guardian. The Foundation abides by the requirements of the Children’s Online Privacy Protection Act (COPPA) and other relevant laws.

The Foundation does not knowingly collect, use or disseminate any personally identifiable information from children under the age of 13. If, however, The Foundation becomes aware that personally identifiable information regarding a child under the age of 13 has been collected at the Site, The Foundation will delete such information from its records.

No Third Party Beneficiaries  

Any products and services offered through this website or by Kris Krohn, UpLife Group LLC, or any of its subsidiaries is made for the exclusive benefit of, and is binding upon, Company and the Mentoring Customer, and the irrespective heirs, successors, and assigns. No other person or entity will have any interest under this Agreement or be classified as a third-party beneficiary.

Video and Audio Recording 

You may be solicited for video and audio testimonials (photographs, audio and/or video) and the recording may be used for promotional and marketing purposes and/or distributed or offered for sale, and authorizes Kris Krohn, and UpLife and all entities acting with its permission or upon its authority, the absolute right and unrestricted permission to use Client’s participation, name, voice and/or likeness in the recordings, and to copy, sell or otherwise distribute such recordings and in future promotional materials for the Program. Client also assign any rights (e.g. copyrights) in the recording, or contribution to the recording, Kris Krohn, and UpLife and understands that no compensation will be provided in any way, beyond being a participant in the creation of, and perhaps being identified in, the recording, and hereby waives any right to approve the recording.

Confidential Information  

The Company has developed and implemented confidential strategies and programs, which include market research, marketing plans, client and contact lists, methods of operating, research, website design, service systems, development of product and information including product and information development strategies, methods of delivering product and information, pricing of services, training manuals, specialized forms and website and other trade secrets and confidential information regarding the its business operations and other information that is not generally known to the public (collectively, “Confidential Information”). Except as may be authorized in writing, Customer agrees to hold all Confidential Information of the Company in confidence and agrees not to disclose such Confidential Information to any third party or to use such Confidential Information during or after termination of this Agreement. Customer agrees to deliver promptly to the Company upon termination of this Agreement all memoranda, notes, notebooks, records, reports, and any other documents containing the other party’s Confidential Information and all copies of the foregoing. None of the Company’s intellectual property, digital courses, programs, logos, pamphlets or other digital intellectual property can be used for any purpose (other than personal use) without prior written approval from an Officer of the Company. They are not eligible for resale.

Modifications to Policy

The Foundation reserves the right to change this policy at any time by posting the latest version on the Site. Any changes to this Policy will be effective immediately upon posting. Use of the Site after notice of changes will be deemed acceptance of such changes. Be sure to review this Privacy Policy periodically to ensure that you are familiar with the most current version. This statement and the policies outlined here are not intended to and do not create any contractual or other legal rights in or on behalf of any party.

Right to Cancel

You, the Customer/Buyer, may cancel this Purchased/Agreement without fees at any time prior to midnight of the third business day after the date of the transaction or receipt of the product, whichever is later.

Cancellation must be in writing, delivered by hand or sent certified mail to company’s corporate office at 1440 N Moon River Drive or by calling 385-294-0133 to speak with a customer service representative Monday to Friday between the hours of 9am and 5pm Mountain Time. Without the receipt of a written cancellation notice from Customer or the receipt of an email confirmation of cancellation from Company, no cancellation will be effective. All sales are final. There are no refunds outside of the Three-Day Right of Rescission.
